ICW Warranty issued a warranty on outdated plans, signed off on an incomplete dwelling and issued it to the developer (I am the landowner/policyholder!)
ICW Warranty issued to the developer a warranty 4th August 2023 on an incomplete new build relating to my land/ property that was signed off on the WRONG plans (a totally different house/ foundation footings and structures) and had exclusion clauses on the garage structure (on a totally different property) with a garage that is incomplete and works are still ongoing onsite. Let me be very clear; ICW Warranty is not fit for purpose. FCA regulated, they have ignored my concerns as a landowner/ initial policyholder for two years and are committing a suspected fraud that has been reported to FCA and Action Fraud. Apparently their own ICW Warranty Policy of the Builder updating land ownership details within 72 hours need not apply (so why have an iCW Warranty Policy at all). Obviously I have no ICW Warranty cover on the property ( a criteria for new build mortgage) to make final payment to the builder.... I am UNABLE to make final stage payment (as the building society are withholding the first step on a two stage sequenced event on the final stage payment) until ICW Warranty addresses the fabricated warranty (being relied by a landowner and a self-build mortgage provider within a legal construction contract).
Updated 24/07/26: As you can see the reply back from ICW is inadequate. It should be that they take my feedback seriously to conduct a FCA Report (as they are registering a suspected fraud that requires to be FCA reported as it is reported to them, for investigation). The essence, ICW is writing a warranty that is fabricated (so the policyholder doesn't realise in time for the final payment) that the warranty does not provide adequate cover (presumably only found out on a claim). For clarity, the policy is required to be 'set up' correctly in the initial policyholders name (the landowner/ building society). ICW Warranty are in the game to defraud landowners and building societies with their current processes / policy that is not adhered to. Needless to say, I will never be transferring that fabricated policy into my name! Yet, the legal construction contract requires a 10 New Build Warranty by ICW to be procured (by the builder) in my name as landowner/ initial policyholder. Procured is exactly that... procured in my name as the landowner/ initial policy holder. ICW Warranty Policy (special clause) requires that the builder is required to update the land ownership details within 72 hours of land transfer. Obviously they have issued an incorrectly set up warranty (on wrong plans that were never built) and released this policy to the builder (whom has no insurable interest)... and then it impacts onto the legal construction contract so that I (and the building society) are UNABLE to pay final stage payment. Perhaps if ICW Warranty adheres to its own FCA approved policies then Mr Spratt wouldn't be getting his knickers in a twist with his rogue builder that he is so willing to protect !! As stated... ICW Warranty is not fit for purpose and does not take suspected fraud via builder misrepresentation seriously enough to warrant aninvestigation for the FCA (which they are required to report under their FCA regulated rules to trade under licence). For clarity, and in summary, Structural warranty providers like ICW operate on the principle of utmost good faith. If ICW discovers that a builder made a false representation to secure the certificate, they are contractually entitled to void the policy from its inception. Obviously there is some resistance from ICW Warranty and the MD Mr Spratt, over a two year period, to do just that.
