Failing to provide a specimen of breath for analysis can be regarded as more serious than drink driving (as the police are prevented from investigating properly). If impairment from alcohol is high and the refusal to provide is deliberate the sentencing guidelines indicate a 12 week prison sentence as the starting point for consideration (in terms of sentence). In your case we could not dispute these two main points and so the aim was to avoid an immediate prison sentence if possible. As you saw in court today this was a close run thing but I am glad the court was persuaded, in the end, to suspend the sentence. Thank you for your review.

Some offences such as drink or drug driving result in mandatory minimum disqualifications of one year. Of course, sometimes the duration of the disqualification can be much longer. In cases in which clients are tendering 'Guilty' pleas it is usually necessary in court to deal with aggravating factors put forward by the prosecution and then seeking to persuade the court that these are outweighed by the mitigating factors. I am pleased to say that, in the circumstances of your case, we succeeded in this resulting in the minimum ban possible. Thank you for your review.

Reading was 95. Caught in the act.
I was initially hesitant to pay so much. I found it very hard to justify this.
The reason why went with Sunil was simply because he gave me honest advice free of charge, came across as genuine and most importantly gave logical reasoning.
Hard to see what is the right thing to do when emotionally charged but given the facts presented and above, the decision was made without hesitation or doubt.
I had spoken to several solicitors as anyone would do in my situation. Not one gave me any confidence. Most actually wanted me to try to defend myself although the facts in my case didn't make it seem like a wise approach.
Now seeing the result, I can see why it was worth it.
Sunil prides himself on transparency, integrity and takes an honest approach.
I am sincerely impressed with his intellect. The way he had methodically represented me made it hard to hold myself from smiling in court despite the circumstances.
I received the least of every aspect the court could have applied.
He is well-spoken, very efficient and effective in his work. I have nothing but praises. Always available via phone 7 days a week.
Never once I struggled to contact him. I in fact spoke to him on a Sunday when first in touch. He took his time with me!
The fee was upfront and inclusive of all the necessary work.

Once charged with drink driving the most important thing is not to panic and to think clearly about your options. In your case you rang a series of specialist drink drive solicitors who encouraged you to plead 'Not Guilty' even though you had been caught red-handed and had provided a positive specimen. When clients first contact me I will speak to them without charge or obligation to provide initial and frank guidance. I am glad you found this useful. Voluntary Police Interview - Drink Driving
After being arrested for drink driving, I was in a complete state and confused about where to even begin in regards to finding the appropriate legal representation for my case. I stumbled across Sunil’s services on Google and contacted him immediately. I told him that I had been invited to attend a voluntary interview at the police station (since this could not be conducted on the night of the incident), during which I would admit full responsibility for the offence. Sunil suggested that we met in person to discuss my personal circumstances in order to decide on the best course of action for mitigation. He subsequently drafted a pre-prepared statement for me to use at the interview. I came to the meeting with a very long list of questions, but by the time the two hours had passed, he had answered all of these in extensive detail (without me even needing to bring them up).
His knowledge and advice was very impressive, he was approachable and he went to great lengths to fully understand my situation. When I left our meeting, I felt much more comfortable about the prospect of attending a police interview on my own. This advanced help and preparation was invaluable. If I had relied solely on the duty solicitor during that interview, I fear I wouldn’t have been represented in the best way possible. Before instructing Sunil, I hadn’t even known that it was possible to bring a pre-prepared statement to a police interview!
From our very first phone call, it was clear he wanted the best possible outcome for me and was going to do everything in his power to make that happen. Police interviews for motoring offences can be deferred for various reasons such as the suspect is unwell or has been injured or for some other reason. This allows time for the suspect to provide instructions and to obtain detailed legal advice in a private and relaxed setting well in advance of the interview (as you chose to do). The various options as to how to approach the interview can then be discussed and, in your case, you attended armed with a pre-prepared statement which was based upon your instructions but which set out your version of events clearly and concisely. In this way your case can be put across in the most favourable possible light. I was really pleased that, in the end, matters turned out really well for you. Thank you for your review.

Most of my clients plead 'Guilty' but cannot afford the consequences of a driving disqualification as this can often mean loss of job and / or livelihood. Consequently, I take full instructions from my clients, as to both the offence and and as to what a ban would mean for them, well in advance of the hearing date, advise the client on steps to take in advance of the hearing and then I present the case as persuasively as possible in court. This approach maximises the prospects of a successful outcome. The more thoroughly and skilfully it is undertaken the better the chance of the result the client seeks. Last year I was captured on a speed camera doing an excess of 100mph on the M25. I drive for a living and I was very worried about losing my license for 6 months. I took legal advice and it didn't look promising until I was recommended to Sunil at Kent traffic Law, he was honest with me but also confident. Penalty Points Disqualifications usually result in 6 month bans which, for those whose livelihoods depend upon the ability to drive, can be an absolute disaster and can sometimes cause a perfectly good business to become insolvent. Consequently, it is really important to go to court fully prepared and ready to put forward whatever arguments are most likely to result in a favourable outcome. Unparalleled representation
I engaged with Sunil following receipt of pending prosecution for speeding (102mph in a 70). Sunil came recommended by a colleague, however recommendations don’t do justice to the unparalleled professionalism and service he provides.

Offences of speeding at over 100mph are increasingly common and, although courts can vary, some are particularly harsh when it comes to sentencing. For my clients avoiding a ban, if at all possible, is the priority and although there can be no guarantees, careful preparation and persuasive presentation of a case in court will maximise one's chance of avoiding a ban. I have a small business which is dependent upon my driving licence. I faced a motoring prosecution for using a mobile phone and intended to plead ‘Guilty’ until I met Sunil who advised me, in a face to face consultation, that I had a defence to the charge. At 101 mph you would reasonably have expected to have been required to attend court for consideration of a disqualification (I have seen many cases of motorists being banned for driving at this speed). However, we decided to try our luck at the Single Justice Procedure Notice stage by sending a carefully crafted mitigation statement with your 'Guilty' plea also stating that you did not wish to attend court. I am pleased to say it worked! You received the most lenient penalty possible ie 6 points and a fine without having to attend court. Thank you for your review.

Whenever a motorist tenders a 'Guilty' plea it becomes a case of seeking to mitigate the damage. Most motorists facing a mandatory ban don't want to be disqualified for a day longer than necessary. However, as you saw in court today, the cps were keen to tell the court about the 'aggravating' factors in your case. My job, as defence counsel, was to persuade the court that the 'mitigating' factors should be given more sway. Penalty Points Ban Avoided by arguing Exceptional Hardship!
I contacted Sunil after I received a Single Justice Procedure Notice and seeked some advice. I asked that he represent me in court. He explained the whole procedure making sure that I understood everything and was very helpful and polite and most of all very knowledgeable. Speeding offense - Ban Avoided
I contacted Sunil after receiving notice of a speeding offence.
I had been caught doing 94mph on a 60mph limit road whilst rushing my daughter to the hospital for treatment after having a seizure. Sunil did an excellent job of presenting my defense and managed to prevent me from being issued a 56 day ban. Sunil advised that I gave a guilty plea with mitigating circumstances which was accepted so I received 6 points and a fine which was the best possible outcome. I feel without Sunil's help i would certainly of received a ban which would of strongly affected my business and career as a garage workshop owner.

If you plead 'Guilty' to an offence you are entitled to 'credit for the plea'. This tends to result in the court being more sympathetic to the mitigation. In your case the mitigation was good and the consequences of a ban would have been dire given the nature of your business. Despite all of this, as you saw, the court seemed to be on the brink of disqualifying you anyway. The moral of your case is never assume the court will be understanding and ensure the mitigation is presented as persuasively as possible. The Magistrates retired to consider whether they would impose a penalty points disqualification in your case. When they returned it was stated that their decision was a close run thing (or words to that effect). That is why it is important to prepare such cases carefully and to present them in court as persuasively as possible.
